January 3, 2006 - Proposed Amendments to the NPDES Regulations for Stormwater Discharges Associated with Oil and Gas Exploration, Production, Processing, or Treatment Operations, or Transmission Facilities EPA has issued a proposed rule that seeks to implement a provision of the Energy Policy Act of 2005 that exempts most stormwater discharges from oil and gas exploration, production, processing, or treatment operations, or transmission facilities, including associated construction activities, from the requirement to obtain NPDES permit coverage. Proposed Peak Wet Weather Discharge Policy EPA is seeking comments on a proposed policy for addressing peak wet weather events at wastewater treatment plants. The proposed policy describes the limited circumstances when certain management techniques may use to address very high flows that result from storm events. These techniques seek to ensure the continued safe operation of the treatment facility and to ensure the protection of human health and nearby waterbodies. Extension of Compliance Dates for Concentrated Animal Feeding Operations The Agency is also proposing to extend the principle compliance dates in the National Pollutant Discharge Elimination System (NPDES) permitting requirements for concentrated animal feeding operations (CAFOs). The extension is in response to changes required by the Second Circuit Court of Appeals decision in Waterkeeper Alliance et al. v. EPA. Please visit EPA website for more information on this topic.
Proposed Stormwater Permit for Industrial Activities EPA is soliciting public comment on its NPDES Stormwater Multi-Sector General Permit for Industrial Activities (MSGP) through February 16, 2006 (comment period was extended a month). The proposed permit will replace the MSGP-2000 that expired on October 30, 2005. The MSGP covers 29 categories of industrial activity in the five states, territories, and other areas where EPA remains the permitting authority. (Most states are authorized to implement the NPDES program and issue their own stormwater permits.) Guidance to Control Urban Runoff Pollution On December 6, 2005, EPA released the National Management Measures to Control Nonpoint Source Pollution from Urban Areas. This comprehensive document will help local governments and others protect water resources from polluted runoff that can result from everyday activities and urban development. The guidance will also help municipalities and other regulated entities implement their Phase I and Phase II NPDES Stormwater programs. This publication includes voluntary guidance on 12 management measures designed to prevent and control runoff pollutants from urban and suburban lands. The management measures cover topics such as watershed assessment and protection runoff from new and existing development, road networks, and construction sites septic system impacts pollution prevention and inspection and maintenance of urban runoff management practices.
