This is the list, that the state is required by the Federal Clean Water Act to create, which lists all waterbodies in the state that are not expected to meet surface water quality standards after the implementation of technology-based controls. The state must prioritize the waterbodies and schedule them for the development of a total maximum daily load (TMDL) which establishes that maximum amount of a pollutant that may be introduced into a waterbody and still ensure it will meet water quality standards. The proposed Integrated List is available for review and comment on MassDEP’s website.

BEAT Note: The proponent was asking for a waiver so they would not have to submit an Environmental Impact Report (EIR) even though they met the threshold on traffic which would have required an EIR. The site is right next to the Mass. Pike Exit 2. It abuts the Housatonic River and is in floodplain. It also has an Activities and Use Limitation due to a previous chemical release. The plan calls for both a diesel fueling station and a gasoline fueling station, not to mention truck and car parking within 50 feet of the river. BEAT believes this project warrants a full Environmental Impact Report.
